Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the website, digital properties, donation pages, volunteer forms, and SMS/text messaging programs operated by Heart of Texas Conservatives PAC (“Heart of Texas Conservatives PAC,” “we,” “us,” or “our”). By using our site or services, you agree to these Terms.

If you do not agree, do not use our site or services.

You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding agreement, or that you are using the site under the supervision of a parent/guardian.

You may use our site and services for lawful purposes only. You agree not to:

• Violate any law or regulation
• Attempt unauthorized access to systems or data
• Interfere with the site’s operation (e.g., malware, scraping that degrades performance, denial-of-service)
• Post or transmit unlawful, defamatory, harassing, or infringing content
• Impersonate another person or misrepresent your affiliation
   

If we accept donations or contributions through the site:

Payment processing

• Payments may be processed by third-party processors. You agree to their applicable terms in addition to ours.
• We may receive transaction metadata (e.g., amount, date, status), but typically do not store full payment card details.
   

Accuracy

• You agree to follow event rules, venue requirements, and staff instructions.
• We may refuse admission or remove individuals for unsafe or disruptive behavior.
   

If you opt in to receive texts from Heart of Texas Conservatives PAC:

Consent

• By providing your mobile number and opting in, you consent to receive SMS/MMS messages from us, which may include informational, advocacy, fundraising, volunteer, and event-related messages.
   
• Consent is not a condition of purchase or donation.
   

Message frequency

Opt-out

Carriers

Program integrity

• You agree not to use our SMS program for unlawful purposes, and not to interfere with the program or attempt to circumvent opt-out mechanisms.
   

All content on our site—text, graphics, logos, videos, and design elements—is owned by Heart of Texas Conservatives PAC or licensed to us and is protected by applicable intellectual property laws.

You may view, download, and print content for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works without written permission.

If you submit content (e.g., messages, testimonials, photos, comments):

• You represent you have the rights to submit it.
   
• You grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute it for organizational purposes (including communications and promotion), unless you request otherwise in writing.
   
• We may remove content at our discretion.
   

Our site may include links to third-party sites or tools (payment processors, social platforms, event tools). We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

Our site and services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law:

• We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Heart of Texas Conservatives PAC and its officers, volunteers, agents, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of (or inability to use) the site or services.

If liability cannot be excluded, our total liability will not exceed the amount you paid to us (if any) in the six (6) months prior to the event giving rise to the claim.

You agree to indemnify and hold harmless Heart of Texas Conservatives PAC and its officers, volunteers, agents, and service providers from claims, liabilities, damages, and expenses (including attorneys’ fees) arising from your use of the site/services, your violation of these Terms, or your violation of any rights of another.

Your use of the site is also governed by our Privacy Policy. If there is a conflict between these Terms and the Privacy Policy, the Privacy Policy controls with respect to privacy matters.

We may update these Terms at any time. Changes are effective when posted. Your continued use after changes means you accept the updated Terms.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising from these Terms will be brought in the state or federal courts located in Travis County, Texas, and you consent to that jurisdiction and venue.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

These Terms (and the Privacy Policy) constitute the entire agreement between you and Heart of Texas Conservatives PAC regarding the site and services, and supersede any prior agreements on the subject.
